Supplemental Conditions of Contract

  1. LandOne, Inc. will be solely responsible for the materials, labor, and equipment necessary to execute the installation. Drawings and details may need to be adjusted, based upon changing site conditions.
  2. In the case of live plant installations, it may be necessary to substitute similar plants due to availability in the nurseries. You will be advised of these changes as they occur.
  3. LandOne, Inc. will not be responsible for any loss, damage, or delay caused by weather conditions, or any other conditions beyond our control.
  4. Alterations, additions, or deviations as requested by the Owner can increase or decrease the final cost of the job to the Owner.
  5. LandOne, Inc. will be responsible for calling Ohio Utilities Protection Service (OUPS) prior to commencing work. The Owner will be responsible for disclosing all property lines, corners, downspouts, underdrainage, "invisible fence", irrigation, etc. prior to commencing work. LandOne will exercise extreme caution in marked areas, however, these items may still be damaged. LandOne, Inc. cannot assume liability for these items, and repairs will be passed on to Owner at cost on final billing.
  6. LandOne, Inc. will provide the initial watering of plants and sod. Owner is responsible for maintaining watering requirements as outlined in the maintenance guidelines provided with the final bill and available on our web site www.landonelandscape.com
  7. Terms: Invoice payable upon receipt - 2% finance charge per month compounded daily will be added on past due accounts if not paid within 30 days. (Annual rate 24%) A fee of $25.00 will be charged for returned checks.

Landscape Warranty

  1. LandOne, Inc. warrants its plants to be state inspected, true to name, size, and in good growing condition when they are installed. For a period of one (1) year, LandOne, Inc. will guarantee plants to be in a satisfactory growing condition.

    Exceptions:

    1. Plants not properly maintained and watered as outlined in the maintenance guidelines.
    2. An act of God causing circumstances or events beyond or control.
    3. Drainage problems.
    4. Plants receiving mechanical or vandal damage.
    5. Plants in raised pots or planters.
    6. Annuals, perennials, ornamental grasses, groundcover, and bulbs.
    7. Transplants.
    8. Accounts that have not been paid in full.
  2. Seeding installations are guaranteed for 60 days if installed during seeding windows. The two windows are May 1 - June 1 and Sept. 15 - Oct. 15. All other installation times are not guaranteed.
  3. Hardscape installations are guaranteed for a period of one (1) year. If settling occurs, area will be repaired one time after the construction has gone through one freeze/thaw cycle.
